Montebello Farm agent for the above named stallion will herein be referred to as Breeder. The
service engaged subject to the following:
1. A Non-refundable booking fee of $___________ is payable with this contract. The balance of
$__________ plus all unpaid expenses will be payable upon receipt of an invoice or when mare
leaves the farm, whichever is first. The Breeder requires 48 hours advance notice when the Mare
Owner wishes to remove mare(s) from the farm. The mare (and foal, if applicable) shall be
released only upon payment in full of all outstanding invoices, including those from the attending
veterinarian. The breeding season in force for this contract shall begin February 1 and close July
15 of the year on this contract.
2. Mare care per day Dry $_____ Wet $_____ Box stall on availability $_____ There shall be no refund in part or in full for this service. There will be a $35.00 fee charged on all returned checks payable by the mare owner/agent.
3. Mare shall be in healthy, sound breeding condition. A licensed veterinarian's certificate confirming breeding soundness, negative coggins, current deworming and vaccinations shall accompany mare. Failure to furnish veterinarian certification shall be mare owner's authorization to have the mare examined and brought current on requirements by the stud owner's veterinarian at mare owner/agent's expense. Mares with aggressive temperaments will not be accepted.
4. Mare shall be halter broke and have rear shoes removed to be acceptable for breeding. Failure to remove rear shoes shall be mare owner's authorization to have shoes removed at mare owner/agent’s expense.
5. A photocopy of both sides of mare's registration certificate shall accompany the mare and become the property of the stallion owner.
6. Montebello Farm shall not be held liable for accident, sickness, disease, theft or death of mare and/or foal. Stallion owner/Agent shall provide care and supervision for mare and/or foal.
7. Mare owner shall not be held liable for accident, sickness, disease, injury or death of stallion.
8. Stallion owner/agent shall diligently try to settle mare. If mare does not settle, mare owner/agent shall not hold stallion owner/agent liable.
9. Live foal guarantee: Live foal means the foal shall stand and nurse. It is understood that if the mare proves barren, aborts her foal or if foal is stillborn a return season will be guaranteed the following year only, providing proper notification was given. Proper notification shall be defined as follows: Written certification by a licensed veterinarian within seven days that the mare has aborted or produced a non-viable foal. Mare Owner certifies that such abortion or death did not result from any act or omission of the Owner. Booster rhinopneumonitis vaccinations must be administered as indicated by the individual drug manufacturer as the mare progresses through her pregnancy. Failure to do this will void the Live Foal Guarantee.
10. There shall be no live foal guarantee on mares leaving our facility prior to being vet checked safe in foal by our attending veterinarian unless mare is ultra- sounded for pregnancy within sixteen (16) to eighteen (18) days following last breeding date and palpated at forty five (45) to forty-seven (47) days after last breeding date. Written veterinarian certification of ultrasound and palpation shall be provided to stallion owner.
11. A breeder's certificate will be issued to Mare Owner after &I expenses have been paid in full and upon notification of the birth of the foal.
12. It is further agreed that should the stallion die or become unfit for service the mare owner/agent has the right to a full refund which is the stud fee minus the non-refundable booking fee. Mare care and veterinary expenses are non-refundable.
13. The signing of this contract entitles Breeder to charge ten percent annual interest on all past due invoices. Past due billing is defined as those amounts no paid within thirty days of invoicing.
14. This contract is not valid unless completed in full. When mare owner signs and returns contract and booking fee to Breeder, Breeder will notify Mare Owner within ten (10) days of approval. Upon notification, it will become a binding contract on both parties subject to the above terms and conditions.
